Consent to Personal Data Processing

This Consent is provided in accordance with Russian Federal Law No. 152-FZ of 27 July 2006 «On Personal Data».

By registering in Edel Way Fit and checking the corresponding box in the registration form, the User (the «Data Subject») gives their free, specific, informed and conscious consent to the processing of personal data on the following terms.

1. Data Controller

2. Personal Data Covered

The Data Subject consents to the processing of the following personal data:

• nickname (username) and email address;
• name and profile photo (if voluntarily added);
• training data: workout plans, sessions, exercises, working weights;
• body measurements and nutrition data (if voluntarily filled in);
• progress photos (if voluntarily uploaded);
• technical data: IP address, device/browser type and version, operating system.

3. Purposes of Processing

• User registration and identification in the Service;
• Providing Service functionality: workout plans, progress tracking, trainer interaction;
• Sending transactional notifications (email confirmation, password reset);
• Account security;
• Customer support and Service improvement.

4. Processing Operations

The Controller is authorised to perform the following operations: collection, recording, organisation, accumulation, storage, refinement (update, modification), retrieval, use, transfer to infrastructure providers solely for technical service operation, deletion and destruction of personal data.

Processing is carried out using automated means.

5. Data Transfer

Personal data is stored on servers of the hosting provider Beget (Beget LLC) located in the Russian Federation(data localisation under Art. 18 cl. 5 FL 152-FZ is met).

By giving this Consent, the Data Subject also consents to the transfer of their email address to Resend Inc.(USA) for the purpose of delivering transactional service messages (account verification, password reset). Transfer to the USA is carried out on the basis of this Consent and for the performance of the agreement with the Data Subject (Art. 12 cl. 4 FL 152-FZ). The data transferred is limited to the email address and the content of the service message.

Personal data is not transferred to third parties for commercial purposes.

6. Duration of Consent

This Consent is valid from the moment of registration in the Service until it is withdrawn by the Data Subject or until account deletion.

7. Withdrawing Consent

You may withdraw this Consent at any time by:

• Sending a written request to support@edelwayfit.com;
• Using the «Delete Account» feature in the Settings section of the Service.

Requests about the scope and purposes of data processing are answered within 10 business days(Art. 20 FL 152-FZ). Upon receiving a withdrawal request, the Controller will stop processing personal data and delete it within 30 days(Art. 21 cl. 4 FL 152-FZ), unless otherwise required by applicable law.

8. Consequences of Withdrawal

Withdrawing consent means it will no longer be possible to use the Service, as data processing is a necessary condition for its provision. The Controller will notify you of this before carrying out the withdrawal request.
